Disputes between Owners

All businesses need to be aware of what can happen if things go wrong - whether it’s a customer making a claim, a supplier failing to deliver or a client threatening to terminate your services.

By spending time a the outset to consider what could go wrong, you can make sure you are able to deal with these risks and you understand how to deal with these problems when they arise.

While many contracts give the parties a right to terminate the contract if the other party fails to perform, often this doesn’t solve the problem because the innocent party is left without the benefit of goods or services they need or the defaulting party is left without an opportunity to fix a problem they could have resolved.  The end result is that the parties may be left with no other choice but to go to court, which can be time consuming and expensive.

When we advise on contracts, we help you focus on these issues and suggest ways to provide for more practical solutions if a dispute arises.  We encourage our clients to think about including meaningful dispute resolution mechanisms in their contracts and to work with the other parties to find commercial answers to disputes.

Of course, not all problems that arise can be solved simply and disputes can escalate.  Recognising that some disputes are more serious or difficult than others, we offer a full range of services in asssting you in negotiating over business disputes, ranging from mediation through to structured mediation processes and if necessary taking action in Court on your behalf to enforce your rights.

Our commercial litigation lawyers are experienced and effective and able to represent our clients in court if needed.  Having said that, our aim is always to find the best way to resolve your dispute and we will not recommend litigation unless we believe there are no other more appropriate options.  If your dispute cannot be resolved by negotiation or mediation, we can provide the services necessary to assist you in pursuing your legal remedies through the Australian courts.
